1. Acceptance of these terms

By accessing or using the PayPer, LLC website at payperup.com (the “Site”), you agree to these Terms of Use. If you do not agree, do not use the Site. These terms govern website use only; any merchant processing relationship is governed by separate agreements and underwriting decisions.

2. Informational use only

Content on the Site—including descriptions of services, pricing characterizations, timelines, and industry examples—is provided for general informational purposes. It does not constitute an offer, commitment, or guarantee of any rate, feature, timeline, or merchant account approval.

3. No guarantee of approval

Submitting a contact form or merchant application through the Site does not create a contract and does not guarantee approval for payment processing or any other service. Approval depends on underwriting, applicable network and partner requirements, and other factors outside this Site.

4. Permitted use

You may use the Site for lawful business inquiries related to PayPer’s services. You agree not to misuse the Site, attempt to disrupt it, submit false or misleading information, or use automated means to scrape or overload the Site without our prior written permission.

5. Intellectual property

PayPer names, logos, and Site content are owned by PayPer, LLC or its licensors. You may not copy, modify, or distribute Site materials for commercial purposes without our prior written consent, except for temporary viewing as needed to use the Site.

6. Third-party services

Form submissions may be processed by third-party providers (such as FormSubmit). Your use of those services may also be subject to their terms. Links to third-party sites, if any, are provided for convenience; we are not responsible for their content or practices.

7. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYPER, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM SITE USE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
